These Terms & Conditions ("Terms") govern your use of babbitt.app (the "Site"), operated by Babbitt Australia Pty Ltd (ABN 34 695 388 277) ("Babbitt", "we", "us", "our"). By using the Site or submitting any form on it, you agree to these Terms. If you do not agree, please do not use the Site or submit a form.
1. About the Site
Babbitt is in early development. The Site provides information about Babbitt and lets you register your interest, join the waitlist, or contact us. Content and features are provided for general information, may be incomplete or change at any time, and do not constitute a binding offer of any product, price, or service.
2. Using the Site
You agree to use the Site lawfully and not to:
- use it in any way that breaches applicable laws or regulations;
- attempt to gain unauthorised access to, interfere with, or disrupt the Site or its systems;
- submit false, misleading, or another person's details without permission; or
- copy, scrape, or reuse Site content except as expressly permitted.
3. Forms, waitlist & communications
When you submit a form (for example, the waitlist, early-bird registration, or contact form), you confirm the details you provide are accurate and that you consent to us contacting you about Babbitt, including product updates and marketing communications. We send email via our email provider, EmailOctopus. You can unsubscribe at any time using the link in our emails. Registering interest or "locking" an early-bird offer does not create a binding contract, charge any payment, or guarantee availability, pricing, or access.
4. Your information & privacy
We collect the information you provide through our forms (such as your name, email address, business name, and role) to respond to you, manage the waitlist, and send updates you have consented to receive. This information is stored with our email provider (EmailOctopus). We do not sell your personal information. We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). To access, correct, or delete your information, contact us via the Site.
5. Intellectual property
All content on the Site — including text, graphics, logos, the Babbitt name and brand, and design — is owned by or licensed to Babbitt and is protected by intellectual-property laws. You may not reproduce, distribute, or create derivative works from it without our prior written permission.
6. No warranties
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties about the Site's accuracy, completeness, reliability, or availability, and pre-launch information may change without notice.
7. Limitation of liability
To the maximum extent permitted by law, Babbitt is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Site. Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded.
8. Third-party links
The Site may link to third-party websites or services (for example, CodeChecker or our demo). We are not responsible for the content, policies, or practices of those third parties.
9. Changes to these Terms
We may update these Terms from time to time. The current version is always the one published on this page. Continued use of the Site after changes are posted means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia.
